By accessing or using the Pharmissy platform operated by Pharmissy LLC ("Pharmissy," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services.

• Facilitates health assessments and intake questionnaires
• Connects you with independent, licensed healthcare providers
• Coordinates prescription fulfillment with licensed pharmacy partners
• Processes payments for consultations and services
• Provides communication tools between you and providers

4. Eligibility

To use our services, you must:

• Be at least 18 years of age
• Be located in a state where our provider network is licensed to practice
• Provide accurate and complete information
• Have the legal capacity to enter into these Terms

5. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your information
• Notify us immediately of any unauthorized access
• Not share your account with others

6. Medical Services Disclaimer

Healthcare services are provided by independent, licensed healthcare providers who are not employees or agents of Pharmissy. These providers:

• Make all clinical decisions independently
• Are solely responsible for the care they provide
• May decline to prescribe treatment if clinically inappropriate
• Maintain their own malpractice insurance

Prescription decisions are made solely by providers. Completing an assessment does not guarantee you will receive a prescription. Providers may determine that treatment is not appropriate for your condition.

By using our services, you agree to pay all applicable fees. Our payment terms:

• Consultation fees are charged at the time of submission
• Fees cover access to provider review, not guaranteed prescriptions
• Medication costs are separate and charged by pharmacy partners
• Refunds may be issued at our discretion if a provider is unable to review your case

9. Pharmacy Services

Prescription fulfillment is provided by independent, licensed pharmacy partners. Pharmissy does not dispense medications. Pharmacy partners are responsible for:

• Verifying prescriptions
• Dispensing medications accurately
• Providing medication counseling
• Shipping and delivery

10. Prohibited Conduct

You agree not to:

• Provide false or misleading health information
• Use the platform to seek controlled substances inappropriately
• Share prescriptions or medications with others
• Attempt to circumvent our security measures
• Use the platform for any unlawful purpose

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PHARMISSY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OUR SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.

Pharmissy is not responsible for the actions, decisions, or omissions of independent healthcare providers or pharmacy partners.

You agree to indemnify and hold harmless Pharmissy, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services or violation of these Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in Hillsborough County, Florida.

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website. Your continued use of our services after changes become effective constitutes acceptance of the modified Terms.
